Rental Agreement

Customer Rental Agreement

This Customer Rental Agreement (the “Rental Agreement”) is between COVABL (“COVABL,” “we,” “us,” or “our”), and the customer placing a rental order (“you” or “your”). This Rental Agreement applies to each rental order you place with COVABL and is incorporated into the order confirmation for that rental.

Version September 24, 2026

By affirmatively accepting this Rental Agreement and completing a rental order accepted by COVABL, you agree to these terms and the transaction-specific terms disclosed at checkout, including the item rented, rental dates, price, applicable fees, delivery/pickup details, and any item-specific replacement value or verification requirement.

1. Eligibility and Account

You must be at least 18 years old, legally able to enter into a binding contract, maintain a valid COVABL account, and provide accurate contact, delivery, and payment information, including a reachable mobile number for courier coordination while a rental is active. COVABL may require reasonable identity, payment, or fraud-prevention verification before accepting or fulfilling a rental, particularly for high-value merchandise.

You are responsible for activity conducted through your account and for keeping your account credentials secure. Rentals are for your personal use unless COVABL expressly agrees otherwise.

2. Rental Orders and Availability

Submitting a rental order is a request to rent the selected item for the dates shown at checkout. A rental is confirmed only after COVABL accepts the order and sends confirmation.

Inventory is limited. Many items may be one-of-one. An item shown on the Site may become unavailable because of a prior renter’s late return, damage, failed inspection, cleaning or repair needs, inventory error, or another operational issue.

If COVABL cannot fulfill a confirmed rental, COVABL may offer an alternate item or alternate dates, but will not substitute an item without your approval. If no acceptable alternative is available, COVABL will refund or restore the amount paid for the affected rental, including any COVABL credit used, as applicable.

3. Rental Period

Your rental period begins and ends on the dates stated in your order confirmation. The order confirmation will identify the scheduled delivery date and the date by which the item must be made available for COVABL’s authorized return pickup (the “Return By Date”).

COVABL may offer different rental-length options. The rental period selected and confirmed for your individual order controls.

4. Rental Price, Taxes, Fees, and COVABL Credit

The rental price and any applicable taxes, courier charges, or other ordinary transaction charges will be disclosed before you complete checkout. If you have eligible COVABL credit, you may apply it as permitted by the applicable credit terms.

If your available COVABL credit does not cover the full amount due, you must pay the remaining balance using an accepted payment method. Amounts due because of late return, loss, theft, significant damage, repair, replacement, or other breach of this Rental Agreement generally may not be paid with promotional or Keyholder credit unless COVABL expressly permits it.

5. Payment Method and Authorization

You must provide a valid payment method accepted by COVABL. Payment processing is currently expected to be provided by Stripe or another payment processor identified at checkout.

To the extent permitted by law, you authorize COVABL to charge your payment method for amounts you expressly agree to at checkout and for additional amounts that become due under this Rental Agreement, including approved late fees, repair costs, replacement charges, and other amounts described below. COVABL will provide notice or documentation of post-rental charges as required by applicable law and COVABL’s policies.

For designated high-value rentals, COVABL may place a temporary authorization hold on your payment method if the hold and its amount, or the method used to determine the amount, are disclosed to you before or at checkout. An authorization hold is not a completed charge, but it may temporarily reduce your available credit or funds. The timing of release after COVABL releases the hold may depend on your payment processor or card issuer.

Nothing in this Rental Agreement limits any rights you may have to dispute a charge with your card issuer or payment provider. If a payment is reversed or charged back but the underlying amount is later determined to remain lawfully due under this Rental Agreement, that amount remains payable to COVABL, subject to applicable law.

If COVABL must use a third-party collection service or legal process to recover an amount that is lawfully due and remains unpaid, you may be responsible for reasonable collection costs and attorneys’ fees only to the extent permitted by applicable law.

6. Courier Delivery

COVABL arranges local courier delivery to the delivery address confirmed for your order. You are responsible for providing a complete and accurate address, access instructions, gate codes, apartment or building information, and a reachable phone number.

You must ensure that delivery can be completed safely and securely during the applicable delivery window. COVABL may require an in-person handoff, signature, photo confirmation, secure drop location, or other delivery verification depending on the item and location.

Responsibility for the item transfers to you when the item is delivered to you, an authorized recipient, or the delivery location or method you authorized, subject to applicable law and any contrary terms shown at checkout. An authorized recipient may include an adult household member, doorman, concierge, front desk, mailroom, building staff member, assistant, or another person you direct or permit to accept delivery on your behalf. If you authorize unattended delivery or a specific secure-drop location, responsibility transfers upon documented delivery to that authorized location.

7. Return Pickup

At the end of the rental period, COVABL will arrange return pickup through an authorized courier.

Your order will include a confirmed return pickup window on your Return By Date. Your rental must be packed, complete, accessible, and available for collection throughout your entire confirmed pickup window. Your return deadline is the end of that pickup window.

You are responsible for providing any access reasonably necessary for collection, including gate codes, building access, front-desk instructions, or other pickup information.

Your responsibility for the rental item continues until it is collected by COVABL’s authorized courier or otherwise returned in a manner expressly approved by COVABL.

If the courier arrives during your confirmed pickup window and the rental is not ready, complete, or accessible for collection, the rental may be considered late and may be subject to the late-return provisions of this Agreement.

If your rental is ready and available for pickup during your confirmed pickup window, but the courier does not complete the pickup due to a delay or issue caused by COVABL or its courier, your return will still be considered on time. You must reasonably cooperate with COVABL to arrange a replacement pickup.

If the rental has not been made available for collection by the end of your confirmed pickup window for reasons within your control, it will be considered late.

8. Extensions

A rental extension is not automatic. You must request an extension before your Return By Date. Extensions are subject to COVABL approval, availability, the next confirmed rental, cleaning/turnaround requirements, and any additional rental charge disclosed to you. If COVABL does not approve the extension, the original Return By Date remains in effect.

9. Condition at Delivery and Pre-Existing Issues

COVABL inspects merchandise before delivery. Because many items are pre-owned, vintage, or previously rented, an item may show minor signs of prior use that do not materially affect wearability.

COVABL may photograph, record video of, or otherwise document rental merchandise before delivery and after return, including its condition, included components, packaging, authenticity markings, serial numbers, and inventory identifiers. COVABL may consider those records together with customer-provided information when evaluating pre-existing condition, damage, missing components, substitution, or other condition-related issues.

Please inspect the item promptly after delivery and notify COVABL before wearing it if you believe the item is materially damaged, incomplete, or materially different from the confirmed order. Photos may be requested so COVABL can document the condition and determine the appropriate solution.

10. Fit and Fit-Related Assistance

Designer sizing varies, and COVABL cannot guarantee that an item will fit you exactly. Size, fit, measurement, and stylist notes are provided to assist your selection but are not a fit guarantee.

If an item does not fit, contact COVABL promptly. COVABL may attempt to help identify an alternative or other solution when inventory, timing, geography, and courier availability permit. Any “fit rescue” or replacement assistance is subject to availability and is not guaranteed unless COVABL expressly states otherwise in a separate policy applicable to your order.

11. Care of Rental Merchandise

You must exercise reasonable care while the rental item is in your possession and use it only in a manner consistent with normal personal wear.

Unless COVABL expressly instructs you otherwise, you may not:

  • Wash, dry clean, spot-treat, dye, bleach, or otherwise clean the item yourself;
  • Alter, tailor, cut, permanently hem, repair, glue, or otherwise modify the item;
  • Apply fashion tape, adhesive strips, temporary-hemming products, patches, glue, or other adhesives directly to the item, or use pins or fasteners in a manner likely to leave holes, pulls, residue, or other damage;
  • Iron, steam, press, or expose the item to a garment steamer, hair-styling tool, or other direct heat source unless COVABL expressly authorizes it;
  • Remove, replace, conceal, or tamper with designer labels, serial numbers, authenticity markings, inventory tags, or COVABL identification;
  • Transfer, sub-rent, sell, pledge, lend, or give possession of the item to another person for their use;
  • Use the item for an unlawful purpose or in a manner reasonably likely to cause unusual damage.

Routine cleaning by COVABL after normal use is included in the rental service unless otherwise disclosed. Please return the item without attempting to clean it yourself.

12. Travel With Rental Merchandise

If you choose to travel with rental merchandise, you remain responsible for safeguarding it throughout the trip, including while it is in a vehicle, airport, airplane, hotel, resort, luggage-storage area, coat check, or the custody of an airline, hotel, transportation provider, household member, travel companion, or other third party.

Travel, transportation delays, delayed or lost baggage, hotel handling, or similar travel-related circumstances do not automatically extend the rental period or the Return By Date. If you anticipate a return problem, contact COVABL as soon as possible. Any extension must be expressly approved by COVABL.

If rental merchandise is lost, stolen, or materially damaged while traveling, you must comply with the notice and cooperation requirements in Section 16. Where reasonably applicable, you must promptly make and reasonably cooperate with any airline, hotel, transportation-provider, police, courier, or insurance report or claim and provide COVABL with available claim numbers or supporting documentation.

If you take rental merchandise outside the United States, you are responsible for complying with applicable customs, import, export, and travel requirements. COVABL’s courier delivery, pickup, and any optional replacement or fit-related assistance are available only within COVABL’s then-current service area unless COVABL expressly agrees otherwise.

13. What Must Be Returned

You must return the same item COVABL delivered to you, together with all item components and accessories identified as part of the rental, such as belts, detachable straps, removable embellishments, or other included pieces. Styling props or accessories shown in photography are not part of the rental unless specifically identified in the product listing or order confirmation.

14. Normal Wear and Routine Cleaning

Ordinary wear consistent with proper use and stains that COVABL can remove through its normal cleaning process are generally included in the rental price. COVABL will not charge you merely for ordinary wear or routine cleaning.

15. Significant Damage and Repair

You may be responsible for damage beyond normal wear, including tears, burns, holes, broken hardware, material pulls, missing embellishments, permanent staining, unauthorized alterations, or other damage requiring repair beyond routine cleaning.

If COVABL determines that an item can reasonably be repaired, COVABL may charge you the reasonable cost of repair, restoration, replacement parts, or specialized cleaning attributable to the damage, up to the applicable Replacement Value of the item. COVABL should provide reasonable documentation of the charge.

16. Loss, Theft, Destruction, Counterfeit Swap, and Failure to Return

You are responsible for safeguarding rental merchandise while it is in your possession. If an item is lost, stolen, destroyed, intentionally substituted, materially altered beyond repair, or not returned, COVABL may charge you up to the item’s applicable Replacement Value, less any amount COVABL is legally required to credit or offset.

If you believe an item has been lost or stolen, or if it becomes materially damaged while outside your immediate control, you must notify COVABL as soon as reasonably possible and, absent circumstances making that impracticable, no later than 24 hours after discovery. You must reasonably cooperate with COVABL’s investigation and with any reasonably applicable police, airline, hotel, transportation-provider, courier, or insurance report or claim. COVABL may request photographs, a police report, claim number, written incident report, or other reasonable documentation.

Returning a counterfeit, different item, materially altered item, or substitute in place of the rented item is prohibited and may result in account termination, recovery of the Replacement Value, and referral to law enforcement where appropriate.

17. Replacement Value

“Replacement Value” means the amount assigned by COVABL to the item for purposes of loss, non-return, destruction, or irreparable damage. Because COVABL may rent limited, discontinued, vintage, or difficult-to-replace designer merchandise, Replacement Value may reflect the item’s retail value, current replacement cost, scarcity, condition, and other reasonable factors disclosed or applied in accordance with COVABL’s policy and applicable law.

18. Late Returns and Missed Pickups

A late return can prevent another customer’s confirmed rental and disrupt COVABL’s courier scheduling, inspection, cleaning, and turnaround. You must make the complete rental item ready, accessible, and available for collection throughout your confirmed return pickup window. If the item is not available for collection by the end of that window for reasons attributable to you, the item will be considered late.

Late fees begin on the calendar day following your Return By Date. For each item that remains late, COVABL may charge 25% of the item’s standard 4-day rental price for each late calendar day, subject to a minimum of $20 and a maximum of $100 per item per day. The standard 4-day rental price means the regular rental price before promotional discounts, credits, or other reductions.

The late fee is intended to cover the costs and disruption caused by the late return, including an ordinary additional courier pickup attempt. COVABL will not separately charge an additional pickup fee for an ordinary replacement pickup that results from the late return. Payment of a late fee does not extend your rental period or give you the right to keep an item beyond the Return By Date.

If your rental is ready and available for collection during your confirmed pickup window but the courier does not complete the pickup because of a delay or issue attributable to COVABL or its courier, your return will be considered on time. You must reasonably cooperate with COVABL to arrange another pickup.

If an item remains unreturned for 7 or more calendar days after the Return By Date, COVABL may classify the item as unreturned and pursue the remedies described in Section 16, Loss, Theft, Destruction, Counterfeit Swap, and Failure to Return, including charging the applicable Replacement Value where permitted by law. Once COVABL charges the Replacement Value, additional late fees for that item will stop accruing. Any late fees already paid for that item will be credited toward the Replacement Value so that the total amount collected for late fees and Replacement Value does not exceed the applicable Replacement Value.

Repeated or material late returns or missed pickups may result in restrictions on future rentals, additional verification requirements, restrictions on access to certain merchandise, or suspension or termination of your COVABL account.

If you anticipate difficulty returning an item on time, contact COVABL as soon as possible and, where possible, before your Return By Date. Contacting COVABL does not automatically extend the rental period or waive applicable fees, but COVABL may work with you to arrange an appropriate return solution.

19. Cancellations and Rental Refunds

Your ability to cancel a confirmed rental and receive a refund or COVABL credit depends on how far in advance you cancel. Unless otherwise disclosed at checkout for a particular rental, the following cancellation policy applies:

  • If you cancel 7 or more calendar days before the scheduled delivery date, you will receive a full refund of the amount paid for the rental. Any COVABL credit used will be restored to your account.
  • If you cancel 3 to 6 calendar days before the scheduled delivery date, the amount paid for the rental will be returned as COVABL credit to your account rather than refunded to your original payment method.
  • If you cancel less than 72 hours before the scheduled delivery date, the rental is non-refundable.
  • Once COVABL has begun fulfillment of the rental, including preparing the item for delivery or dispatching it through a courier, the rental is generally non-refundable.

If COVABL Credit was used to pay all or part of a rental that qualifies for a refund or credit under this section, the applicable amount will be restored to your COVABL account.

Any refund to an original payment method may take additional time to appear depending on your payment provider.

This cancellation policy does not limit any refund or other right required by applicable law.

20. COVABL Cancellation or Fulfillment Failure

COVABL may cancel a rental if the item becomes unavailable, fails inspection, is returned late by a prior renter, is damaged, cannot be safely fulfilled, or if COVABL reasonably determines that payment, identity, fraud-prevention, or eligibility requirements are not satisfied.

If COVABL cancels because the item cannot be fulfilled and the cancellation is not caused by your breach, COVABL will return the amount you paid for the affected rental to the original form of payment or restore applicable COVABL credit, as appropriate. COVABL may also offer an alternate item or date, but you are not required to accept it.

21. Product Information, Styling, and Photography

COVABL attempts to describe merchandise accurately, but colors may appear differently depending on lighting, photography, screen settings, and device displays. Size and fit can vary by designer and garment.

Only the merchandise and included components expressly identified in the product listing or order confirmation are included in your rental. Shoes, jewelry, bags, props, or other styling pieces appearing in editorial or product imagery are not included unless expressly identified as part of the rental.

If COVABL identifies a material error in a product description, price, availability, or order before fulfillment, COVABL may correct the error and, if it materially affects your transaction, provide you an opportunity to accept the correction or cancel for an appropriate refund.

22. Personal Use; No Resale or Sub-Rental

Rental merchandise is provided for your temporary personal use only. You may not sell, rent, sub-rent, consign, pledge, transfer ownership of, or commercially exploit the merchandise. Title to all COVABL-owned rental merchandise remains with COVABL at all times.

23. Intellectual Property and Authenticity Materials

Designer trademarks and other third-party intellectual property remain the property of their respective owners. You may not remove or tamper with authenticity markings, serial numbers, labels, inventory identifiers, or other identifying materials associated with the item.

24. Communications About Your Rental

You must maintain a working email address and reachable mobile number associated with your account while a rental is active. COVABL may contact you by email, phone, or non-marketing text message as reasonably necessary to administer your rental, including delivery, pickup, account verification, security, payment, return reminders, damage issues, or customer support. Message and data rates may apply. Marketing communications are handled separately in accordance with applicable law and COVABL’s Privacy Policy, and consent to marketing text messages is not required to rent from COVABL.

25. Suspension and Termination

COVABL may restrict or terminate your ability to place future rentals if you materially breach this Rental Agreement, fail to pay amounts lawfully due, including amounts that remain lawfully due after a payment reversal or chargeback, repeatedly return items late, engage in fraud, misuse merchandise, provide false information, or otherwise create a material risk to COVABL’s inventory or operations. Account termination does not eliminate payment obligations or other rights and remedies that arose before termination.

26. Disclaimer of Certain Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, COVABL PROVIDES RENTAL MERCHANDISE AND RELATED SERVICES ON AN “AS IS” AND “AS AVAILABLE” BASIS, SUBJECT TO THE EXPRESS PROMISES IN THIS RENTAL AGREEMENT. COVABL DOES NOT GUARANTEE THAT A PARTICULAR ITEM WILL FIT, THAT EVERY ITEM WILL BE AVAILABLE FOR A PARTICULAR DATE, OR THAT THE SERVICE WILL BE UNINTERRUPTED.

Nothing in this Rental Agreement excludes warranties, remedies, or consumer rights that cannot lawfully be excluded.

27. Limitation of Liability

To the fullest extent permitted by law, COVABL will not be liable for indirect, incidental, special, consequential, or punitive damages arising from a rental transaction, including loss of an event opportunity, substitute wardrobe expense, or similar consequential loss, except where such limitation is prohibited by law. Any aggregate liability cap should be determined and drafted by counsel.

28. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless COVABL and its affiliates, officers, directors, managers, members, employees, agents, successors, and assigns from and against third-party claims, liabilities, damages, judgments, and reasonable out-of-pocket costs, including reasonable attorneys’ fees, to the extent arising out of or caused by:

  • Your unlawful, fraudulent, or unauthorized use of rental merchandise;
  • Your sale, sub-rental, transfer, pledge, unauthorized alteration, or misuse of rental merchandise;
  • Bodily injury or property damage caused by your misuse of rental merchandise or other wrongful conduct while the merchandise is in your possession;
  • Your violation of another person’s rights in connection with your use of COVABL or the rental merchandise; or
  • Your material breach of this Rental Agreement that results in a third-party claim against COVABL.

This indemnification obligation does not apply to the extent a claim results from COVABL’s own negligence, gross negligence, willful misconduct, violation of law, or breach of this Rental Agreement.

COVABL will provide you with reasonable notice of a covered third-party claim and may control the defense and resolution of that claim. You agree to reasonably cooperate with the defense. COVABL will not settle a claim in a manner that requires you to admit wrongdoing or undertake a non-monetary obligation without your consent.

This section does not create an independent obligation for you to provide or control COVABL’s legal defense unless you and COVABL separately agree otherwise in writing after a claim arises. It also does not limit your direct obligations to COVABL under the provisions of this Rental Agreement relating to damage, loss, theft, late returns, failure to return merchandise, or other amounts lawfully due.

29. Dispute Resolution

PLEASE READ THIS SECTION CAREFULLY. EXCEPT FOR CERTAIN CLAIMS DESCRIBED BELOW OR IF YOU TIMELY OPT OUT, IT REQUIRES YOU AND COVABL TO RESOLVE DISPUTES THROUGH INDIVIDUAL BINDING ARBITRATION RATHER THAN IN COURT.

Before commencing arbitration or a court proceeding, either you or COVABL must first provide the other with written notice describing the dispute and the requested resolution. A notice to COVABL may be sent to hello@covabl.com and to COVABL’s mailing address listed at the end of this Rental Agreement. Your notice should include your name, the email address associated with your COVABL account, the applicable order number if available, a description of the dispute, and the relief you are requesting.

You and COVABL agree to attempt in good faith to resolve the dispute for at least 30 days after the notice is received before commencing arbitration. This requirement does not prevent either party from bringing an eligible claim in small claims court or seeking emergency relief where waiting would cause immediate and irreparable harm. Any applicable limitations period will be tolled during this 30-day period to the extent permitted by law.

Except as provided below, any dispute, claim, or controversy arising out of or relating to this Rental Agreement, a COVABL rental, rental merchandise, charges associated with a rental, or the relationship between you and COVABL will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration provision. The arbitrator may award the same individual remedies that would otherwise be available in court, subject to applicable law and this Rental Agreement. Judgment on an arbitration award may be entered in any court having jurisdiction.

Either you or COVABL may bring an individual claim in small claims court if the claim qualifies for that court and remains there on an individual basis.

Unless the parties agree otherwise or the arbitrator determines that an in-person hearing is necessary, arbitration may be conducted by video conference, telephone, written submissions, or another method permitted by the applicable AAA Consumer Arbitration Rules. If an in-person hearing is required, it will take place in the county where you reside or at another location mutually agreed upon by you and COVABL, unless applicable law requires otherwise.

Arbitration fees and costs will be allocated according to the AAA Consumer Arbitration Rules and applicable law. COVABL will pay any arbitration fees and costs that the applicable rules or law require COVABL, as the business that drafted this arbitration provision, to pay. Each party will otherwise be responsible for its own attorneys’ fees and costs unless applicable law or this Rental Agreement permits the arbitrator to award them.

Individual Claims Only

YOU AND COVABL AGREE THAT, TO THE FULLEST EXTENT PERMITTED BY LAW, EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

An arbitrator may not combine the claims of more than one person or preside over a class, collective, consolidated, or representative proceeding unless you and COVABL expressly agree otherwise in writing or applicable law requires otherwise.

Nothing in this section is intended to waive any right to seek public injunctive relief that California law or other applicable law does not permit a consumer to waive.

Right to Opt Out of Arbitration

You may opt out of this arbitration provision without affecting your ability to use COVABL.

To opt out, you must email hello@covabl.com within 30 days after the first date you accept a COVABL Rental Agreement containing this arbitration provision. Your email must:

  • Use the subject line “Arbitration Opt-Out”;
  • Include your full name;
  • Include the email address associated with your COVABL account;
  • Include your order number, if applicable; and
  • Clearly state that you are opting out of the arbitration provision.

An opt-out applies only to the arbitration requirement and does not affect the remainder of this Rental Agreement.

Claims Not Subject to Arbitration

If a claim is not subject to arbitration under this section, including because you timely opted out, the dispute will be resolved in accordance with the governing-law and venue provisions of this Rental Agreement, except where applicable law requires otherwise.

If any portion of this arbitration provision is determined to be unenforceable as applied to a particular claim or form of relief, that portion will be severed to the extent permitted by law, and the remaining portions will continue to apply. Any claim or remedy that applicable law requires to proceed in court may proceed in court while the remaining arbitrable claims are handled in arbitration, to the extent permitted by law.

30. Governing Law

This Rental Agreement is governed by applicable federal law and the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.

31. Electronic Agreement and Records

You agree that this Rental Agreement may be accepted electronically. COVABL may maintain electronic records showing the version accepted, date and time of acceptance, order information, and related transaction records.

32. Changes to This Rental Agreement

COVABL may update this Rental Agreement prospectively. The version accepted for a confirmed rental will govern that rental unless a change is required by law or you validly agree to a different version. Material changes applicable to future rentals will be posted or otherwise communicated as required by law.

33. Severability; No Waiver; Entire Agreement

If a provision of this Rental Agreement is invalid or unenforceable, it will be enforced to the maximum extent permitted or severed as appropriate, and the remaining provisions will remain effective. COVABL’s failure to enforce a provision on one occasion is not a waiver of future enforcement.

This Rental Agreement, the order confirmation, and any transaction-specific policies expressly incorporated at checkout constitute the agreement governing the applicable rental. The COVABL Website Terms of Use and Privacy Policy apply separately as described in those documents.
